The draft rule Summary and Presentation Memo are now available now at the above link. They appear to be mostly satisfactory and well thought out.

However (you knew there'd be a however...) there is still a discretionary power assigned to the FWC which allows it to permit collection if the applicant for the collection permit can show such collection is "vital to the project."

Since there appear to be no other criteria for allowing collection it would seem to be an open door to once again violate the site.

Maybe there will be further changes to this "back door" at the meeting? It seems to require much more specific and restrictive language.

Be there and maybe we'll help the FWC folks with this effort!

Perhaps there could be required a FWC monitor on site for such extraordinary collections. If there is additional cost for such a monitor, then that cost is borne by the applicant. This is similar to the NOAA requirements for special permits in the National Marine Sanctuaries....

The meeting this morning seemed to go quite well - at least for those of us who were in favor of stopping commercial collectors using the BHB/PFP site as a source for tropical ornamentals.

The FWC agreed to support the proposed new regulation as a draft rule, modifying it slightly to enlarge the area for the prohibition of collection.

The rule may be finalized at the next FWC meeting in February. When the time and place are posted I'll start another thread here.

BIG "thank-yous" to all who worked on this, and to the approximately 75 or so supporters who attended this meeting.

Tom
